General (sale, rental of goods and rental of services)
All conditions listed below apply to all deliveries, placements, invoices, orders, and rental contracts executed by us. You are deemed to have explicitly and unambiguously accepted these conditions when you place an order, give an order, or sign a rental contract. Deviations from these conditions are not enforceable against us unless we have accepted them in writing.
We only accept written orders and assignments. If we have agreed on the price by telephone, you must confirm the price in a signed letter or email.
If the deadline is not explicitly stated, our price offer is binding for 15 days from the date the offer was made, subject to force majeure. You must notify us in writing of any errors in the offer within 3 days of receiving it. The prices listed on contracts and offers include 21% VAT, unless otherwise stated.
Retention of title
The following retention of title applies to all our sales: Discolife retains ownership of all delivered and undelivered goods. The installed materials remain the property of Discolife and cannot be used as collateral or be the subject of a seizure.
Payment
You pay an invoice by the due date, and a rental invoice is paid when the equipment is picked up or delivered. If you do not pay on time, we charge a fixed compensation of 15% of the total amount, with a minimum of € 50, and the applicable legal interest. This is done without prior notice. Every started month counts as a full month. All outstanding invoices and/or rental invoices become due as soon as you fail to pay, and all pending orders and/or deliveries are postponed until you have paid all overdue payments.
Complaints
You must report complaints to us within 8 days of receiving the invoice in a registered letter; after that, no complaints will be accepted. If disputes arise, only the courts of the Brugge district are competent. In that case, please note that you will have to bear the court costs and enforcement costs.
Rental of goods/services
We only rent equipment in perfect condition. You are obliged to report visible defects, which are defects that manifest themselves from the first use, directly to us. The same applies to hidden defects, which are defects that may only manifest themselves later. If you fail to do so, the resulting damage may be claimed from you.
You may only subrent equipment with our written consent.
You are obliged to treat the equipment as a "good housefather". Some special conditions:
Rental period
A rental period runs as agreed in the quote. If you return the goods late or make it impossible for us to pick them up at the agreed time, we will charge you a full rental day for each started rental period.
If you want to rent for multiple days, there are special coefficients for this.
Theft / Loss
In case of irreparable damage or theft or loss, the new value will be charged.
Damage
If you do not return the rental material or damage it, you will be responsible for the full repair and replacement costs.
Rental deposit
When we request a rental deposit, you will receive it back in cash when you return the rented goods correctly and on time.
If necessary, this deposit can be fully or partially withheld as an advance on repairs, reconditioning, or replacement costs and as extra rent for late return.
The insurance of the rented material against theft or breakage is at the expense and initiative of the renter/organizer.
Cancellation conditions
You can cancel the contract free of charge up to and including 60 days before the start of the agreement. After the 60th day, we will charge a compensation for costs that will be calculated as follows:
Due to the nature of the sector, a week consists of 7 working days.
If Discolife wants to cancel the agreement, you also have the right to the above cancellation rates. The client can never claim a higher compensation than the above cancellation rates. Discolife has the right to cancel the agreement at any time and without being liable for compensation if the client: shows serious signs of insolvency, endangers the safety of our staff or equipment directly or by failing to take necessary safety measures, is suspected of fraud or acts in bad faith.
Placement and operation
You must provide sufficient space at the entrance of the event location to load and unload with a truck. You must also provide a parking space for a van or truck within a radius of 50 meters, unless otherwise agreed in writing.
At the installation location, there must be at least 2 tables and sufficient space to place all rented equipment.
If the location is difficult to access (stairs or +30m distance between the place where the installation must be and the unloading point or other obstacles), you must report this when booking. All equipment must be placed, unless otherwise agreed in writing, on a dry, paved, and frost-free location.
The power supply must be reliable and grounded and may not deviate by more than 5% from 50Hz 400V for three-phase power or 230V AC for normal sockets. The power supply must also be within 10m of the installation location, unless otherwise agreed.
Overloading the network is at the expense of the renter/organizer.
You must, like us, strictly adhere to agreements about operating, placement, or pickup hours.
If the conditions in the above paragraph are not met, Discolife cannot be held responsible for not delivering the installation on time. Discolife may also decide, without you being entitled to compensation, not to use part of the equipment or all of the equipment until the problem is resolved.
If the materials were placed by Discolife, the renter/organizer may only reconnect and/or move them after explicit written permission from Discolife. If they are moved, a fine can be imposed.
Overtime hours
Overtime hours that arise due to non-compliance with the above conditions or because the client does not adhere to agreed schedules will be charged, unless otherwise agreed in the rental contract.
During their activity, our staff must have free access and refreshments. For productions that fall within normal lunch hours, you must also provide a small meal for our staff.
(Cost price = 12.5€/person/meal and 15€/person/day when no free refreshments are provided)
Sound level
As the organizer, you are always responsible for the sound level used, even if a Discolife employee operates the equipment. We will gladly follow your instructions regarding the desired sound pressure and can provide measuring equipment at a small additional cost and/or contractually agree on a sound limit that we will not exceed.
If the applicable sound standards are repeatedly exceeded, Discolife has the right to stop the music activity after a first warning.
In the event of exceeding these sound standards, any resulting fines will be at the expense of the DJ/Organizer/Renter. The DJ/Organizer/Renter undertakes to indemnify Discolife against any damage of any kind (such as broken windows, collapsed system ceilings, and hearing damage). Claims that are made against Discolife as a result of damage suffered by third parties due to non-compliance with the applicable sound standards. If the competent authority requests to lower the sound level, the DJ/Organizer/Renter will immediately comply.
The organizer must ensure the necessary formalities and permits: the permission of the city or municipality, SABAM, Red Cross, Application for the correct category of sound standards, etc. Discolife cannot be held liable for this.
At any time, the staff can have the event stopped if they deem it necessary due to, for example, safety, weather conditions, etc..... Discolife can never be held liable for accidents with or due to the rented equipment (electricity problems, noise pollution, weather conditions,...)
The renter/Organizer declares to be aware of the operation of the individual components and that they will take the necessary care to avoid overloading and other damage.
